The short answer is yes and no. For searches such as degree or employment verifications, the data typically does not change so what is reported in your MyTruSeal report is likely to be the same as an employer would find if an in-house search was completed.
Where data may change is in searches such as criminal records, driver’s histories etc. It is important to understand that when an employer runs your background check though a consumer reporting agency (CRA) for employment purposes, the report and investigation are subject to the Federal Fair Credit Reporting Act (FCRA). The FCRA and even some state laws place reporting guidelines on the types and amount of information that can be placed in a report to an employer for “employment purposes”.
Generally speaking, what would be reportable to an employer by a CRA is more restrictive than a report that is prepared by MyTruSeal for disclosure to subject of the report. Therefore, in many cases the employers report may contain less information than your MyTruSeal report. As an example, in most cases the employer would be prohibited from seeing criminal cases that did not result in a conviction that are older than 7 years. In contrast, your MyTruSeal report could contain information on these cases as it is not subject to the 7 year reporting restriction.
Another possible cause of any discrepancies would be in the types of searches conducted. For example, MyTruSeal currently only offers a criminal record search that is conducted through the National Criminal Index. Although this database contains information on millions of cases from thousands of jurisdiction across the United States, not all jurisdictions report their data into the database. If the employer were to do a more thorough, jurisdictionally based search, it is possible they may develop data that is not included in the National Index and therefore not in your MyTruSeal report.
This is why the information that is included in your MyTruSeal report is not intended to replace the thorough due diligence search an employer would due upon hire. MyTruSeal reports are not intended to be Fair Credit Reporting Act compliant and therefore should not be used in making employment decisions by themselves. It is our recommendation that the employer use your MyTruSeal report as a cursory evaluation tool only.
